    Off-list Pistol ?`

    Just some quick questions and I know that its but once they're answered it can be deleted or whatever. Would it be out of line to ask one of my LE buddies to buy an Off List pistol and then have him sale it to me when he doesnt want it anymore

    Meaning its not illegal for him to sale me a pistol that isnt on the list right? And to clarify being LE they can buy off list pistols? How hard is it if you are LE to do this, can you just go to a local FFL and have them order whatever handgun you want??

      At first glance, it sounds like a straw purchase. However, if the LE buddy buys it, then decides to sell it properly through an FFL to a Legally able person, ( answered correctly on form 4473), then there is no problem. Off Roster handguns are not illegal to own or acquire through private party transfer.

        Normally, a straw purchase is a reference to having someone buy a gun for a prohibited party. That is, a person who otherwise would be denied because of a criminal history or other reason. I'm not a lawyer nor do I play one on TV nor did I sleep in a Holiday Inn Express last night but the description does not sound like a straw purchase to me because the OP is not a prohibited person.

        However, the LE friend is not an FFL. That is to say he is not in the business of buying and selling guns. If he buys the gun with the intention of reselling it, I believe that is a no-no. Kinda like how the DOJ says if I am selling more than 6 handguns a year I am acting as a dealer and should be licensed as such.

        I have a very good friend that is LE. I would not ask him to do this as I think it puts him in a potentially bad spot.

        I suppose you could suggest to him a pistol he may like to try and that if he does not like it you'd take it off his hands. I just would not do it more than once. That would look bad.

          It might also put him in a bad spot with the department. Depending on where you live, there are different internal rules. In the sticks, it may not matter. In a city, it probably will. In general, buying and selling to civilians/non LE is not going to go down well with the guy's superiors, regardless of any straw purchase laws. He is a public servant, not a regular Joe who may do what he pleases. Don't get him in trouble.

            this is not necessarily a straw purchase contrary to many calgunners belief. As mentioned by foxtrot, a straw purchase is when the actual owner wants to hide their identity by having the gun bought by another person, LE or civilian, legally thru an FFL. As long as you can legally own a gun and it transfers into your name, it is legal. I personally would not go around telling people that my cop buddy is buying an off list gun to transfer to me later. Keep it somewhat low key so you don't attract unneccessary attention regardless of its legality. the calgun wiki link above states this pretty clearly in plain english.

              It sorta of does sound like a straw purchase. Foxtrot mention a straw purchase is only when someone buys a gun that someone cannot get legally. Well if it is a off list pistol he could not get it legally unless it is a ppt in CA.

                  It is legal for a LEO to sell PPT their guns to another person but what the OP is talking about is basically asking his LEO friend to buy him an off list pistol and have him PPT it, which in a sense is a straw purchase because the person couldn't get the off list pistol so he had a LEO buddy get it for him instead.

                    Hmm...never heard of the 'Straw Purchase' but thanks for the info. It does sound like a gray area and Im sure it wouldnt be an issue with any of my friends but I dont think its something ill do with everything that you guys posted. I was just wandering because I want a DAMN HK45 so bad I can taste it but I think that it is rediculous that there are people on here selling them for $1500. FRUSTRATING

                        You do not like a 1911 if I remember right, try a 1911 like Kimber, Springfield... HK45 is too thick compare to 1911 or even Sig 220.
                        A non-rostered gun is not necessarily better than a rostered gun, for example, a Taurus PT1911 is not on the list but in no way comparable to my Les Baer 1911s, even my Kimber or SW 1911.

                            I just bought a Kimber TLEII and Im not a fan. And the issue isnt that I want a gun because it is an off-list gun. The issue is that the gun that I want is an off-list gun. If that makes any sense. I just got off of nightshifts so everything is kind of a blur right now

                            HAHA I know that. Ive decided not to even approach the subject with my friends. Ill just have to save up the money and wait for one to pop up on here, as they seem to be popping up pretty regularly lately.
